    TERMS AND CONDITIONS

    Governing all products, programmes and services offered by Art for Thriving

 PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PURCHASING OR PARTICIPATING IN ANY SERVICE, PROGRAMME, OR PRODUCT OFFERED BY GEMMA BOWMAN, TRADING AS ART FOR THRIVING ("COMPANY", "WE", "US" OR "OUR").

BY ENROLLING IN, PURCHASING, OR ACCESSING ANY SERVICE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE LEGALLY BOUND BY THESE TERMS.  IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST NOT ACCESS OR USE OUR SERVICES.

  • 1. INTERPRETATION

    The following definitions apply throughout these Terms and Conditions:

1.1 "Company", "we", "us", "our" means Gemma Bowman AThR, trading as Art for Thriving, a sole trader registered in New Zealand.

1.2 "Client", "Participant", "you", "your" means the individual who purchases, enrols in, or participates in any Service offered by the Company.

1.3 "Services" means all products, programmes, sessions, digital content, ceremonies and any other offerings provided by the Company, whether

online or otherwise, including but not limited to: First Marks with Gem, Your First Marks - Just Begin, Threshold, Return and any future offerings.

1.4 "Content" means all materials including videos, audio recordings, guided activities, workbooks, ceremony protocols, photographs, written materials,

and other intellectual property made available through the Services.

1.5 "Confidential Information" means any personal, emotional, creative, or health information shared by either party in connection with the Services.

1.6 "Site" means www.artforthriving.com and any associated platform used to deliver the Services, including Ivorey.

  • 2. OUR SERVICES

Art for Thriving offers online creative arts therapy group programmes and experiences facilitated by Gemma Bowman AThR - a registered clinical Arts Therapist holding a Master of Arts in Creative Arts Therapy (Clinical) from Whitecliffe College, New Zealand and is registered with ANZACATA (Australia, New Zealand and Asia Creative Arts Therapies Association).

 

Gemma Bowman holds the AThR credential and is a registered member of ANZACATA. Within Return, live sessions with Gemma (including private 1:1 sessions and group share calls) are conducted under her clinical arts therapy registration and ANZACATA's Code of Ethics. First Marks with Gem, Threshold and pre-recorded activities within Return are facilitated as an educator and trained creative practitioner.

All Services draw on Gemma's clinical training and experience, but not all constitute clinical arts therapy in the registered sense.

 

Art for Thriving's group programmes are not a substitute for individual clinical therapy. Participants requiring one-on-one clinical support are encouraged to seek appropriate professional care.

 

All Services are subject to availability. We reserve the right to modify, update, restructure, or discontinue any Service at any time, with reasonable notice provided where practical.

  • 3. ELIGIBILITY

By purchasing or accessing any Service, you confirm and warrant that :

•        You are at least 18 years of age

•        You have the legal capacity to enter into a binding agreement

•        All information you provide is accurate, current and complete

•        You understand that Art for Thriving's group programmes are not individual clinical therapy and are not a substitute for professional mental health

treatment

•        You understand that results from the Services are not guaranteed and will vary between individuals

•        You are voluntarily choosing to participate in these Services

 

Our Services are intended for adults who have considered their own readiness to engage with creative and ceremonial practices and have chosen to participate of their own free will. If you have any concerns about your suitability, please contact us at [email protected] before committing.

  • 4. INTELLECTUAL PROPERTY RIGHTS

4.1 Ownership. All Content created and provided by Art for Thriving through the Services - including but not limited to creative arts therapy frameworks, ceremony protocols, guided activities, videos, audio recordings, written materials and branding - is the exclusive intellectual property of Gemma Bowman / Art for Thriving and is protected by New Zealand and international copyright laws.

 

4.2 Personal Use Licence. Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Content solely for your own personal, non-commercial purposes. This licence does not confer ownership.

 

4.3 Prohibited Uses. You may NOT, without prior written consent from Art for Thriving:

•        Share, distribute, reproduce, resell, publish or publicly display any Content

•        Share your login credentials or access links with any other person

•        Record any live sessions without express written permission

•        Use any Content to create competing products or services

•        Use any Content for commercial purposes

•        Adapt, translate, or create derivative works from any Content

 

4.4 Your Submissions. Any feedback, testimonials, or suggestions you provide may be used by Art for Thriving for the improvement or promotion of the Services, with attribution to your first name unless otherwise agreed in writing.

  • 5. FIRST MARKS WITH GEM

5.1 Overview. First Marks with Gem is a live fortnightly open studio session held online via Google Meet, facilitated by Gemma Bowman as an educator and trained creative practitioner. Sessions run for 60 minutes and are not recorded. This is a live experience - there is no recording available if you miss a session.

 

5.2 Price.  $1USD minimum per session. Non-refundable and non-transferable.

 

5.3 Access. Upon purchase, you will receive a Google Meet link by email prior to the session. Access is for the purchasing individual only and may not be shared.

 

5.4 All Sales Final. All purchases are final and non-refundable.

  • 6. THRESHOLD

6.1 Overview. Threshold is a live three-day online experience facilitated by Gemma Bowman as an educator and trained creative practitioner. Day 1 and Day 3 are live group sessions. Day 2 is a private, self-paced guided creative activity released after Day 1 closes. All three days are recorded and recordings are made available to registered participants.

 

6.2 Price. Pricing is set at the point of sale and displayed at checkout. Introductory or special pricing may be offered from time to time and will be clearly stated at the point of sale. Any credits toward other Art for Thriving offerings will be stated at the point of sale.

 

6.3 All Sales Final. All purchases are final and non-refundable.

 

6.4 Group Environment. By participating in Threshold, you agree to:

•        Treat all other participants with respect, compassion and dignity

•        Maintain the confidentiality of all personal information shared by other participants within the group container, what is shared in the container

stays in the container

•        Refrain from recording any live sessions without express written permission from Gemma Bowman and other participants

•        Participate in a manner that supports a safe and positive container for all

 

6.5 Recording Consent. By registering for Threshold, you consent to Day 1 and Day 3 live sessions being recorded. Full recordings are shared with registered participants only. Any content used for marketing or promotional purposes will be limited to screenshots or short clips in which individual participants cannot be identified.

  • 7. RETURN

7.1 Overview. Return is a six-week online group programme facilitated by Gemma Bowman AThR. It includes two private 40-minute 1:1 sessions with Gemma (conducted under her clinical arts therapy registration), four live 90-minute group therapy calls (conducted under her clinical arts therapy registration), four pre-recorded guided creative activity videos (facilitated as an educator and trained creative practitioner), opening and closing ceremonies, and a bespoke ceremonial box delivered to your door before Week 1 begins. There is a maximum six participants per group.

 

7.2 Price. Pricing is set at the point of sale and displayed at checkout. Payment plans may be offered at Gemma's discretion and will be outlined at the point of sale.

 

7.3 Financial Commitment. By enrolling in Return:

•        You agree to pay the full programme investment or complete your agreed payment plan

•        If a payment plan is selected, all instalments remain payable regardless of continued participation

•        Discontinuing participation does not release you from your payment obligations for any remaining instalments

•        No refunds will be issued on payments already made.

 

7.4 Ceremonial Box. A bespoke ceremonial box is personalised and shipped to your door before Week 1. International shipping times vary and Art for Thriving is not responsible for customs delays or duties. In the event of significant delays beyond our control, we will communicate with you directly.

 

7.5 Group Environment. The group environment conditions outlined in Section 6.4 apply in full to Return.

 

7.6 Recording Consent. Live group share calls and ceremonies may be recorded. Full recordings are shared with registered participants of that cohort only. Any content used for marketing or promotional purposes will be limited to screenshots or short clips in which individual participants cannot be identified.

 

7.7 Cancellation by Art for Thriving. In the unlikely event that a Return cohort must be cancelled before commencement, participants will receive a full refund. If a cohort is disrupted after commencement due to circumstances beyond our control, we will make reasonable efforts to reschedule or otherwise accommodate participants, we will communicate with you directly.

  • 8. YOUR FIRST MARKS - JUST BEGIN

8.1 Overview. Your First Marks - Just Begin is a self-paced evergreen digital product comprising a guided creative video and accompanying PDF, available to access at any time.

 

8.2 Price. $9 USD. Non-refundable and non-transferable.

 

8.3 All Sales Final. All purchases are final and non-refundable due to the immediate digital delivery nature of this product.

  • 9. PAYMENT TERMS

9.1 Accepted Payment Methods. We accept payment via Stripe. All prices are displayed in USD unless otherwise stated.

 

9.2 Payment Plans. Where a payment plan is offered for Return, the following terms apply:

•        You authorise Art for Thriving (via Stripe) to charge your nominated payment method on the agreed schedule

•        It is your sole responsibility to ensure sufficient funds are available on each due date

•        If a payment fails, you must contact us within 24 hours to arrange resolution

•        Failed payments may result in immediate suspension of access to Services until resolved

•        You may not withdraw from a payment plan once you have commenced participation in or accessed any part of the Services.

 

9.3 Price Changes. We reserve the right to change the pricing of any Service at any time. Price changes will not affect payments already made for

Services purchased prior to the change.

  • 10. REFUND POLICY

Art for Thriving operates a firm no-refund policy across all Services. Our Services involve significant preparation, personalised facilitation and the delivery of intellectual property and experiential content that cannot be returned.

 

Specifically:

•        First Marks with Gem ($1USD): All sales are final and non-refundable.

•        Your First Marks - Just Begin ($9USD): All sales are final and non-refundable due to immediate digital delivery.

•        Threshold: All sales are final and non-refundable.

•        Return: No refunds will be issued on payments already made. If a payment plan is in place, all remaining instalments remain legally payable as

contracted.

 

Exceptions include: any credit stated at the point of sale (for example, the Threshold credit toward Return investment) and any refund required by applicable New Zealand consumer protection law.

 

Nothing in this clause is intended to limit or exclude your rights under the New Zealand Consumer Guarantees Act 1993, including your right to a remedy where Services are not provided with reasonable care and skill.

  • 11. HEALTH, SAFETY & CACAO DISCLAIMER

11.1 Participant Health Responsibility. By participating in any Service, you confirm that:

•        You are in a physical and emotional state that allows you to safely engage with creative and ceremonial practices

•        You have consulted with a qualified healthcare provider if you have any medical conditions, mental health diagnoses, or concerns about your

suitability

•        You have disclosed to Gemma Bowman any relevant health information prior to participating.

 

11.2 Ceremonial Cacao Disclaimer. Ceremonial cacao is used as part of the ritual and ceremonial elements of Threshold and Return. By participating in any session that includes cacao, you acknowledge that:

•        Ceremonial cacao may produce physical, emotional and energetic responses including heightened sensitivity, emotional release, or other

•        You have disclosed any relevant medical conditions - including heart conditions, pregnancy, use of MAOIs or antidepressants, or significant trauma

•        Ceremonial cacao is not recommended for individuals who are pregnant, have cardiovascular disease, are taking MAOIs or antidepressants, or

have been advised by a medical professional not to consume it

•        You voluntarily assume all risks associated with consuming ceremonial cacao and agree to hold Art for Thriving harmless from any claims arising

from your participation.

 

11.3 Not a Substitute for Clinical Treatment. While Art for Thriving's programmes draw on Gemma Bowman's clinical arts therapy training, the group programme format is not individual clinical therapy. Participants requiring individual clinical support are encouraged to seek appropriate professional care. Gemma will refer participants on where appropriate.

  • 12. CONFIDENTIALITY

12.1 Clinical Confidentiality - Return 1:1 Sessions and Group Sessions. Gemma Bowman AThR is bound by the ANZACATA Code of Ethics and the professional confidentiality obligations applicable to registered Arts Therapists. These obligations apply specifically to the private 1:1 sessions and live group share calls within Return, which are conducted under her clinical arts therapy registration. All personal information and disclosures shared within these sessions will be held in strict confidence and will not be shared with third parties without your express consent.

 

12.2 Educator and Practitioner Spaces. First Marks with Gem, Threshold, and pre-recorded activities within Return are facilitated by Gemma as an educator and trained creative practitioner rather than as a registered clinical Creative Arts Therapist. Gemma is committed to the same standards of discretion and care across all spaces, however the formal clinical confidentiality obligations of ANZACATA apply specifically to the clinical sessions noted in Section 12.1.

 

12.3 Exceptions to Confidentiality. Confidentiality will be broken where Gemma Bowman reasonably believes there is:

•        An immediate risk of harm to you or another person

•        A legal obligation to disclose (e.g., court order)

•        A regulatory obligation under ANZACATA guidelines

•        Your express permission to share

 

12.4 Group Confidentiality. For all group programmes and sessions, all participants are expected to maintain the confidentiality of personal information shared by other participants within the group container. "What is shared in the container stays in the container."

 

12.5 Supervision. As a registered Arts Therapist, Gemma Bowman engages in regular clinical supervision. Personal information shared in clinical sessions may be discussed with her clinical supervisor, who is also bound by professional confidentiality obligations.

  • 13. PHOTOGRAPHY, VIDEO & LIKENESS

By attending any live online session, ceremony, or event hosted by Art for Thriving and by agreeing to these Terms and Conditions, you acknowledge and agree that:

•        Gemma Bowman may take screenshots or short video clips during sessions for the purpose of programme delivery and promotional use

•        You grant Art for Thriving a non-exclusive, royalty-free licence to use such content across its website, social media, and marketing channels

•        If you do not wish to appear in any promotional content, you must notify Gemma in writing at [email protected] prior to the session and we

will make every reasonable effort to accommodate this request

•        Within Return clinical sessions - including private 1:1 sessions and group share calls - no identifiable content will be used for marketing or

promotional purposes under any circumstances. This is consistent with Art for Thriving's obligations under the ANZACATA Code of Ethics.

  • 14. RECORDING CONSENT

Where sessions are recorded the following applies:

•        Threshold Days 1 & 3 are recorded. Full recordings are shared with registered participants of that cohort only. Short clips or screenshots may be

used for marketing purposes in accordance with Section 13.

•        Return group share calls and ceremonies are recorded. Recordings are shared with registered participants of that cohort only. No recordings or

content from Return clinical sessions will be used for marketing or promotional purposes under any circumstances.

•        Return private 1:1 sessions are not recorded unless explicitly agreed between Gemma and the participant prior to the session.

•        Participants may not record any live session without express written permission from Gemma Bowman and all other participants

•        First Marks with Gem sessions are not recorded. Gemma may take screenshots or short clips for marketing purposes in accordance with Section 13.

  • 15. ARTWORK OWNERSHIP

All artwork created by participants during Art for Thriving sessions remains the sole property of the creator. Gemma Bowman will not use, reproduce, or publish images of participant artwork without permission from the creator.

  • 16. COMMUNITY STANDARDS

Participation in any Art for Thriving group space requires that you:

•        Engage respectfully and compassionately with all other participants

•        Refrain from recording, screenshotting, or sharing other participants' personal shares without their express consent

•        Refrain from promoting your own products, services, or programmes within group spaces without express permission from Gemma Bowman

•        Participate in a manner that supports a safe, warm, and positive container for all.

 

Art for Thriving reserves the right to remove any participant from a group programme at Gemma Bowman's sole discretion for conduct that disrupts the container or violates these Terms, without refund.

  • 17. PROHIBITED ACTIVITIES

When using our Services, you agree NOT to:

•        Use the Services for any purpose that is unlawful, fraudulent, or harmful

•        Share your access, login credentials, or session links with any other person

•        Record any live session without express written permission

•        Use any Content to create competing products or services

•        Harass, intimidate, or harm another participant

•        Misrepresent your identity or qualifications.

  • 18. LIMITATION OF LIABILITY

18.1 To the fullest extent permitted by New Zealand law, Art for Thriving shall not be liable to you or any third party for any indirect, incidental, consequential, special, or punitive damages arising from your participation in the Services.

 

18.2 Where liability cannot be excluded by law, our total aggregate liability to you for any claim arising from the Services is limited to the total amount paid by you for the specific Service to which the claim relates.

 

18.3 Nothing in these Terms excludes, restricts, or modifies any rights you may have under the New Zealand Consumer Guarantees Act 1993 or any other applicable consumer protection legislation.

  • 19. THIRD-PARTY PLATFORMS

Our Services are delivered through third-party platforms including Ivorey, Google Meet and Stripe. We are not responsible for the availability, functionality, or policies of these third-party platforms. Your use of these platforms is subject to their respective terms of service.

  • 20. PRIVACY POLICY

By using our Services, you agree to our Privacy Policy, which is incorporated into these Terms by reference and governs the collection, storage, use, and disclosure of your personal information in accordance with the Privacy Act 2020 (New Zealand).

We collect personal information including your name, email address, city and payment details solely for the purpose of delivering our Services and communicating with you about them.

  • 21. ELECTRONIC COMMUNICATIONS

By purchasing or accessing any Service, you agree to receive electronic communications from Art for Thriving including programme updates, session details, payment notifications and other Service-related notices.

 

You may opt out of marketing communications at any time using the unsubscribe link in our emails. Service-related communications will continue while you are an active participant.

  • 22. MODIFICATIONS & INTERRUPTIONS

Art for Thriving reserves the right to modify, update, or discontinue any aspect of the Services at any time, with reasonable notice provided where practical. We are not liable for Service interruptions caused by circumstances beyond our reasonable control, including illness, technical outages or force majeure events. In such circumstances, we will make reasonable efforts to reschedule or otherwise accommodate affected participants.

  • 23. TERMINATION

23.1 Termination by Art for Thriving. Art for Thriving reserves the right to terminate or suspend your access to any Service, without refund, in the event of a breach of any provision of these Terms, conduct that is harmful or disruptive to other participants or the container, or fraudulent payment or misrepresentation.

 

23.2 Termination by You. If you choose to discontinue participation in any Service, you must notify Art for Thriving in writing at [email protected] No refund will be issued for amounts already paid. If you are on a payment plan, all remaining instalments remain legally payable as contracted.

  • 24. GOVERNING LAW & DISPUTE RESOLUTION

24.1 Governing Law. These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. The parties submit to the non-exclusive jurisdiction of the courts of New Zealand.

 

24.2 Dispute Resolution. In the event of any dispute, the parties agree to first attempt resolution through good-faith informal communication. Please contact us at [email protected] If the matter is not resolved within 14 days, the parties agree to attempt mediation before commencing formal legal proceedings.

  • 25. GENERAL PROVISIONS

25.1 Entire Agreement. These Terms, together with our Privacy Policy and any applicable Programme Agreement, constitute the entire agreement between you and Art for Thriving with respect to the Services.

 

25.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.

 

25.3 No Waiver. Our failure to enforce any right or provision shall not constitute a waiver of that right.

 

25.4 Force Majeure. We shall not be liable for any failure or delay in performance arising from circumstances beyond our reasonable control.

•        You have read and fully understood these Terms and Conditions

•        You agree to be legally bound by these Terms

•        You are at least 18 years of age

•        You enter into this agreement voluntarily and with full knowledge of its terms.
