Art for Thriving (operated by Gemma Bowman AThR, trading as Art for Thriving) is committed to protecting your personal information and your right to privacy. This Privacy Policy explains what information we collect, how we use it, who we share it with & what rights you have in relation to it.

 

This policy applies to all information collected through our website (www.artforthriving.com), our platform (Ivorey), and any related services, programmes or communications.

 

By using our Services, you agree to the collection and use of information in accordance with this policy and in accordance with the Privacy Act 2020 (New Zealand).

  • 1. WHO WE ARE

Art for Thriving is operated by Gemma Bowman AThR, a sole trader registered in New Zealand.

We offer online creative arts therapy group programmes and experiences.

  • 2. WHAT INFORMATION WE COLLECT

    We collect the following categories of personal information:

2.1 Information you provide directly:

        Full name

        Email address

        City (optional - collected to understand our global community and consider timezones)

        Payment details (processed securely via Stripe - we do not store card details)

        Responses to intake questions (e.g. "My creative life is..." on the Threshold registration form)

        Communications you send to us via email or contact forms

 

2.2 Information collected automatically:

        Basic website usage data (pages visited, time on site) - collected via Ivorey platform analytics

        We do not currently use Google Analytics, Facebook Pixel or any advertising tracking tools

 

2.3 Information shared during sessions:

Personal information, creative work and disclosures shared during Art for Thriving sessions (First Marks with Gem, Threshold, Return) are treated with the utmost care and confidentiality. Please refer to our Terms and Conditions for full details of our confidentiality obligations, including our clinical arts therapy obligations under the ANZACATA Code of Ethics.

  • 3. HOW WE USE YOUR INFORMATION

We use your personal information only for the following purposes:

        To process your purchase and deliver the Services you have enrolled in

        To send you session details, Google Meet links, programme updates and other Service-related communications

        To personalise your ceremonial box (Return participants)

        To respond to your enquiries and communications

        To understand where our community is located globally, in order to make informed decisions about session timings

        To improve our Services based on feedback you provide

        To comply with our legal and ethical obligations as a registered Creative Arts Therapist

        We will not use your personal information for any purpose not listed above without your explicit consent.

  • 4. LEGAL BASIS FOR PROCESSING

We process your personal information on the following legal bases:

        Contract: processing is necessary to deliver the Services you have purchased

        Legitimate interests: to communicate with you about your programme and improve our Services

        Legal obligation: to comply with our obligations under the ANZACATA Code of Ethics and New Zealand law

        Consent: where you have specifically opted in to receive marketing communications

  • 5. WHO WE SHARE YOUR INFORMATION WITH

    We do not sell your personal information to any third party. We share your information only in the following limited circumstances:

5.1 Service providers:

        Stripe - payment processing. Your payment details are handled directly by Stripe and are subject to Stripe's Privacy Policy

We do not store your card details.

        Ivorey - our website and programme platform. Your name, email and programme details are stored in Ivorey and subject to Ivorey's Privacy Policy

        Google Meet - live sessions are held via Google Meet and subject to Google Meet's Privacy Policy.

 

5.2 Clinical supervision:

As a registered Creative Arts Therapist, Gemma Bowman engages in regular clinical supervision. Information shared in clinical sessions (Return 1:1 sessions and group share calls) may be discussed with her clinical supervisor in anonymised form.

The clinical supervisor is also bound by professional confidentiality obligations.

 

5.3 Legal requirements:

We may disclose your information where required by law, court order, or where we reasonably believe disclosure is necessary to protect the immediate safety of any person.

 

We do not share your personal information with any other third parties.

  • 6. HOW LONG WE KEEP YOUR INFORMATION

We retain your personal information for the following periods:

        Mailing list and contact information: until you unsubscribe or request deletion

        Purchase and payment records: 7 years from the date of purchase, as required by New Zealand tax law

        Programme participation records: 3 years from the end of your programme

        Clinical session notes (Return 1:1 sessions): retained in accordance with ANZACATA guidelines - minimum 7 years

        Communications (emails, contact form submissions): 2 years

 

After these periods, your information will be securely deleted or anonymised.

  • 7. HOW WE STORE AND PROTECT YOUR INFORMATION

We take reasonable steps to protect your personal information from loss, misuse, unauthorised access, disclosure, alteration and destruction.

These steps include:

        All payment processing is handled by Stripe using industry-standard encryption

        Our website and programme platform (Ivorey) uses secure hosting

        Clinical session notes are stored separately in a secure, encrypted system

        Access to personal information is limited to Gemma Bowman and, where necessary, our platform providers

 

No method of transmission over the internet or electronic storage is 100% secure.

While we take every reasonable precaution, we cannot guarantee absolute security.

  • 8. COOKIES AND TRACKING

Our website may use cookies for basic functionality through our platform provider, Ivorey.

We do not currently use Google Analytics, Facebook Pixel, advertising cookies or any third-party tracking tools.

 

If we introduce any additional tracking or analytics tools in future, we will update this Privacy Policy and notify you accordingly.

  • 9. YOUR RIGHTS

Under the Privacy Act 2020 (New Zealand), you have the right to:

        Access the personal information we hold about you

        Request correction of any inaccurate or incomplete information

        Request deletion of your personal information (subject to our legal retention obligations)

        Withdraw consent to marketing communications at any time by using the unsubscribe link in any email

        Make a complaint to the Office of the Privacy Commissioner (New Zealand) if you believe your privacy rights have been breached

Art for Thriving serves participants globally. Our Services are based from within New Zealand and your personal information is processed and stored in accordance with New Zealand privacy law.

 

If you are located in the European Union or United Kingdom, you may have additional rights under the General Data Protection Regulation (GDPR) or UK GDPR.   • 11. CHILDREN'S PRIVACY

Art for Thriving's Services are intended for adults aged 18 and over. We do not knowingly collect personal information from anyone under the age of 18. If we become aware that we have collected personal information from a person under 18, we will delete it immediately.

If you join our mailing list, we may send you updates about Art for Thriving offerings, session dates and other relevant information.

You can unsubscribe at any time using the unsubscribe link in any email or by contacting us at [email protected]

 

We will never sell your email address or personal information to third parties for marketing purposes.
